Here in the Lowcountry area around Hilton Head Island, South Carolina there is a lot of water. Where there is water, you can bet there will be jet-skis.
We recently talked about an Ohio man who was charged with negligently operating a water vessel on Hilton Head Island, when his watercraft crashed into his guide’s causing the man to lose consciousness and seriously injuring himself. Now, in Hawaii, a 16 year old girl has been killed in a personal watercraft accident, caused again by negligence.
On August 5, 2012, Tyson Dagely, from Australia, was driving recklessly, standing up on his watercraft, showing off for his girlfriend, and not watching where he was going when he ran into the back of Kristen Fonseca’s watercraft. Fonseca’s head hit the steering wheel and then fell into the water. She died a day later because of her injuries.
Dagely has been charged with a 3rd degree negligent homicide, misdemeanor in Hawaii, which carries a maximum sentence of a year in prison and a $1,000.00 fine. He is being held on a $100,000.00 bail. His next court date is August 23.
Dagely’s girlfriend, Natasha Ryan, is also charged with hindering prosecution. Authorities found two deleted videos on the memory stick of her camera that allegedly show the crash. She is free on $500.00 bail. Her next court date is September 7.
Fonseca’s family filed a lawsuit in Circuit Court in Honolulu against Dagely. The suit also names Aloha Jet Ski, the company that rented the personal watercrafts to Fonseca and Dagely, as a defendant. The suit claims that employees “failed to give any instructions or warning about driving at excessive speeds.” The Fonseca family seeks unspecified amount of damages, including medical and funeral expenses.
